1. Acceptance of These Terms
These Terms of Service (“Terms”) govern your access to and use of www.tamarhamilton.com (the “Site”), operated by the campaign of Tamar Hamilton for Broward County Circuit Court Judge, Group 52 (“we,” “our,” “us”). By visiting the Site or submitting information through it, you agree to these Terms. If you do not agree, please do not use the Site.
2. What This Site Provides
The Site is a campaign communication. It provides information about the candidate, her background and qualifications, campaign events, and voting dates and resources, and it allows visitors to join the campaign mailing list and to make a contribution. The Site is informational and is offered without charge. We may add, change, or remove features at any time.
3. Not Legal Advice; No Attorney-Client Relationship
Nothing on the Site is legal advice, and nothing on the Site creates an attorney-client relationship with the candidate, her law practice, or the campaign. References to the candidate’s professional experience are provided for the purpose of describing her qualifications for judicial office. Do not send confidential or time-sensitive legal information through this Site.
Voting information on the Site is provided as a convenience. Election dates, deadlines, and procedures are set by the Broward County Supervisor of Elections and the State of Florida. Please confirm any date or requirement with the official sources linked from the Site before relying on it.
4. Intellectual Property
All content on the Site — including text, graphics, logos, photographs, video, and the campaign name and likeness — is owned by or licensed to the campaign and is protected by applicable intellectual property law. You may share links to the Site and may reproduce campaign materials for personal, non-commercial purposes that support the campaign. You may not use campaign content to suggest an endorsement, affiliation, or authorization that does not exist. Additional restrictions on the use of the candidate’s name, likeness, and campaign materials appear in our Legal Notice.
5. Acceptable Use
You agree not to:
- use the Site for any unlawful purpose, or in violation of any applicable election, campaign finance, or communications law;
- submit false information, impersonate another person, or submit another person’s contact details without their permission;
- scrape, harvest, or collect information from the Site by automated means, including collecting contact details for solicitation;
- reverse engineer, probe, or interfere with the Site, its forms, or the systems that support it, or attempt to gain unauthorized access to any part of it;
- introduce malicious code, or take any action that imposes an unreasonable load on the Site; or
- alter campaign materials in a way that misrepresents the candidate or the campaign.
6. Contributions
Contributions made through the Site are governed by our Contribution Rules, which set out eligibility, limits, and required disclosures. Where these Terms and the Contribution Rules differ on a contribution matter, the Contribution Rules control. Payments are processed by a third-party payment processor; we do not receive or store your full payment card details.
7. Email and Text Communications
If you provide your contact details and consent, we may send you campaign updates by email and text message. Message frequency varies and message and data rates may apply. You may reply HELP for help or STOP to opt out at any time. How we handle the information you submit is described in our Privacy Policy.
8. Third-Party Services and Links
The Site links to and relies on services operated by others, including our payment processor, event and video platforms, social media platforms, and official election websites. We do not control those services and are not responsible for their content, availability, or practices. Your use of a third-party service is governed by that service’s own terms and privacy policy.
9. Disclaimer of Warranties
The Site is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any information on it is complete or current.
10. Limitation of Liability
To the fullest extent permitted by law, the campaign, its officers, volunteers, and vendors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or relating to your use of the Site. Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.
11. Changes to the Site and These Terms
We may update these Terms from time to time. When we do, we will revise the Effective Date above. Your continued use of the Site after a change takes effect means you accept the updated Terms.
12. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Broward County, Florida, and you consent to the jurisdiction of those courts.
